Abstract

This article talks about the relationship of the International Criminal Court with Latin America and the Caribbean. The author goes through the ratification process of the Rome Statute within such countries and of the progressive implementation of national laws that typify the crimes of the Statute. In addition, it is pointed out which has been the role of the Prosecutor of the International Criminal Court in the last years and the main criteria that it has adopted to initiate preliminary exams. Based on these considerations, the author analyses the function developed by the Prosecutor of the International Criminal Court in Latin America, regarding specifically its preliminary exams in Colombia and Honduras. Finally, it discusses the function of the Prosecutor in Latin America and the need of strengthening the International Criminal Court in the region.

Director Ejecutivo de la Comisión Mexicana de Defensa y Promoción de los Derechos Humanos (México D.F.). Licenciado en Derecho por la Universidad Iberoamericana (Ciudad de México) y Doctor en Derecho por la Universidad Car-los III de Madrid. Ha sido Tercer Visitador General en la Comisión de Derechos Humanos del Distrito Federal; Titular de la Unidad para la Promoción y Defensa de Derechos Humanos de la Secretaría de Gobernación; Ministro Responsable de Asuntos de Derechos Humanos en la Misión Permanente de México ante los Organismos Internacionales con Sede en Ginebra y; Coordinador para América Latina y el Caribe de la Coalición por la Corte Penal Internacional, entre otros.
